What Is the Difference between a Summary Eviction & an Unlawful Detainer?
Generally, in Nevada, a tenant can be quickly and summarily evicted for non-payment of rent after the tenant has been served with and failed to comply with a 7 Day Notice to Pay Rent or Quit. This is called a summary eviction procedure. The summary eviction procedure may also be utilized to evict a residential tenant for breach of lease, nuisance, termination of tenancy at will, waste, illegal activities, and for a "no-cause" termination of tenancy. However, a formal unlawful detainer action must be used to recover possession of your property for the following types of cases:
- Evictions following the foreclosure or sale of a property
- Eviction of a commercial tenant on any basis other than non-payment of rent
- Eviction of a tenant who rents a space in a mobile home park
